1. General Information
These Terms & Conditions govern the use of the website, booking system, and participation in activities offered by Georgieva und Luskeviciute GbR, operating as The Beyond Berlin Club (“we”, “our”, or “the organizer”).
By creating an account, purchasing credits, or booking a class, users agree to these Terms & Conditions.
2. User Accounts
2.1 In order to purchase credits or book classes, users must create an account through the website or booking platform.
2.2 Users agree to provide accurate and complete information when creating their account and to keep their information updated.
2.3 Each account is personal and may not be shared with others.
2.4 Users are responsible for maintaining the confidentiality of their login credentials and password.
2.5 Any activity conducted through a user account is considered the responsibility of the account holder.
2.6 The Beyond Berlin Club is not liable for unauthorized use of an account resulting from the user’s failure to protect login credentials.
3. Eligibility
3.1 The booking platform and services may only be used by individuals aged 18 years or older, or minors with the consent of a legal guardian.
3.2 By creating an account or booking a class, users confirm that they meet these requirements.
4. Booking, Payment & Credit System
4.1 All bookings must be made through our website or official booking platform.
4.2 Full payment is required at the time of purchasing credit packs.
4.3 Classes and activities are booked using credits. Credits must be purchased in advance.
4.4 Purchasing credits does not automatically reserve a spot in a class. A booking is only confirmed once:

a class spot is reserved through the booking system, and
-
the corresponding credit has been redeemed.
4.5 Class capacity is limited and bookings are allocated on a first-come, first-served basis.
4.6 Credits and memberships are personal and non-transferable.
4.7 Participants may use credits for different classes or coaches unless otherwise specified.
5. Credit Validity
Credits purchased through credit packs are valid for a limited time from the date of purchase:

8-Class Pack: valid for 10 weeks

4-Class Pack: valid for 6 weeks
-
Single Drop-In Class: valid for 4 weeks
Unused credits automatically expire after the validity period and cannot be refunded, transferred, or extended.
6. Cancellation & Rescheduling
6.1 Participants may cancel or reschedule a booking up to 24 hours before the class start time through the booking platform.
6.2 If a cancellation occurs less than 24 hours before the class, the credit will be forfeited.
6.3 Bookings are generally non-refundable once confirmed, as court time and instructor resources are reserved in advance.
6.4 In exceptional cases, adjustments may be made at the discretion of The Beyond Berlin Club.
7. Changes to Classes or Services
7.1 The Beyond Berlin Club reserves the right to modify, cancel, or reschedule classes, instructors, locations, or services if necessary.
7.2 Participants will be informed as early as reasonably possible if a class is cancelled.
7.3 If a class is cancelled by the organizer, participants will receive a credit refund or may reschedule the session.
8. Locations & Weather Conditions
8.1 Classes may take place at various sports facilities used or rented by the organizer.
8.2 Outdoor classes may be affected by weather conditions.
8.3 If severe weather conditions are forecast, the class may be cancelled and credits will be returned.
8.4 If a class is interrupted due to weather after it has already started and more than 20 minutes have passed, the class will be considered completed.
9. Participation & Health Responsibility
9.1 Participation in sports activities requires a reasonable level of physical fitness.
9.2 By participating in a class, participants confirm that they are physically capable of engaging in sports activities.
9.3 Participants must inform coaches of any injuries or health conditions that may affect their participation.
9.4 Participants must follow all safety instructions provided by coaches or organizers.
10. Assumption of Risk
Participation in sports activities such as tennis involves inherent risks, including but not limited to falls, collisions, muscle injuries, heat exhaustion, or other physical incidents.
By participating in activities organized by The Beyond Berlin Club, participants acknowledge and accept these risks.
Participation is voluntary and at the participant’s own risk.
11. Liability
11.1 The Beyond Berlin Club is liable only in cases of intent or gross negligence.
11.2 Liability for ordinary negligence is excluded unless it concerns essential contractual obligations or injury to life, body, or health.
11.3 Participants are responsible for damages they cause to equipment, facilities, or other participants.
11.4 The Beyond Berlin Club is not liable for lost, stolen, or damaged personal belongings.
11.5 The organizer is not responsible for incidents related to the condition of rented sports facilities operated by third parties.
12. Participant Insurance
Participants are responsible for ensuring that they have adequate health and accident insurance coverage for participation in sports activities.
The Beyond Berlin Club does not provide personal accident or health insurance for participants.
13. Heat & Weather Responsibility
The organizer does not guarantee the availability of shade structures or weather protection during outdoor activities.
Participants are responsible for protecting themselves against sun exposure, heat, and dehydration by bringing appropriate clothing, hydration, and sun protection.
Participation during hot weather conditions occurs at the participant’s own risk.
14. Photo, Video & Media Use
14.1 Photos and videos may be taken during classes or events for documentation and promotional purposes.
14.2 By participating in activities organized by The Beyond Berlin Club, participants agree that photos or videos in which they may appear may be used for marketing, social media, website content, or promotional materials.
14.3 Participants who do not wish to appear in media must notify the organizer before the class or event.
15. Intellectual Property
All content on this website, including text, images, branding, graphics, and design elements, is the property of Georgieva und Luskeviciute GbR unless otherwise stated.
Content may not be copied, reproduced, or distributed without prior written permission.
16. Account Suspension
The Beyond Berlin Club reserves the right to suspend or terminate a user account if a participant violates these Terms & Conditions or behaves in a way that disrupts classes, coaches, facilities, or other participants.
Unused credits may be forfeited in such cases.
17. Force Majeure
The Beyond Berlin Club is not responsible for cancellations or disruptions caused by events beyond reasonable control, including extreme weather conditions, government restrictions, strikes, facility closures, or other unforeseen circumstances.
Classes may be rescheduled or credits returned at the organizer’s discretion.
18. Data Protection
The Beyond Berlin Club complies with applicable data protection laws. Personal data collected through bookings or accounts will only be used for operational and booking purposes.
19. Governing Law
These Terms & Conditions are governed by German law.
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in effect.
